Terms and Conditions

The use of Our Website and Our Services means that you accept the following Terms and Conditions which are legally binding. 

1. Introduction

Yamee Organic Baby Food is an Australian-owned company registered in the state of Victoria, ABN 62 170 434 757.  Our registered business address is: 34 Bronson Circuit, Cranbourne North, Victoria 3977.  We manufacture and deliver organic halal baby food, which is available for purchase from our Website.  These Terms and Conditions are to be entered into between Us and the customer (“You”).

1.1        The Website may be used only for lawful purposes and in a lawful manner.  You agree to comply with all applicable laws, statutes and regulations regarding the website and any transactions conducted on or through the website. 

1.2        Goods detailed on our Website are offered for sale on an invitation to treat basis.  This means that the contract for sale will only become binding on both parties once We are satisfied that the personal details you have provided are accurate and we have accepted your order.  We will refuse to accept your order if:

  • We suspect that you have not provided your real name, phone number, email address, payment details, delivery address and other requested information
  • You have not stipulated a delivery address in the areas to which we currently deliver (see clause 3.1).
  • We cannot obtain authorisation for your payment
  • We identify a pricing or product description error on the Website.

2. Payment

2.1        We accept online payment by providing your credit card details during checkout on our secure site.  Transactions are in Australian dollars (AUD). Our e-commerce site uses 128-bit SSL browser encryption, which makes it extremely difficult for your credit card information to be intercepted. We do not store credit card details, consequently, You must enter your credit card information each time you place a new order.

2.2       We also accept payment by Electronic Funds Transfer (EFT) and by Check.  Once funds are received in our bank account, We will advise You by email of the delivery date.  If We do not receive payment within 7 days of your order, your order will be cancelled automatically.

2.3       If your order includes anything out of stock on the dispatch date, We will contact You by telephone and offer an alternative product which is the equivalent to your order.  If the alternative is not acceptable to you, We will refund you the value of the undelivered product(s).  Should We be unable to contact you to advise you of a shortage of stock, we will send all items which are available and We will automatically reimburse You for the item which was out of stock.

2.4        Currency of transaction is Australian Dollars (AUD) only.

3. Delivery

    3.1 Yamee Organic Baby Food:

        3.1.1.    Home delivery is currently limited to the Greater Melbourne Metropolitan Area
        (including Werribee, Berwick, Frankston, Mornington) and Outer Melbourne                             Suburbs (including Peninsula Region beyond Mornington, Geelong, Bendigo,                             Shepparton, Traralgon, Morwell, Moe and Warragul).  If you are not sure whether                     your suburb is included in our delivery area, please contact us by email at                                 info@yameeorganicbaby.com.au or call us on (03) 9539 4605.

3.1.2     Delivery within the Melbourne Metropolitan Area: will be on the second         business day after you order.  Please note that the cut-off time for order processing is 4 pm Monday to Friday.  For example, you must order by 4 pm on Monday for delivery on Wednesday.  If you place your order after 4 pm on Monday, your order will be processed on Tuesday and delivered to you on Thursday. Orders placed after 4 pm on Friday will be processed on Monday and delivered on Wednesday.  

3.1.3     Outer Melbourne Deliveries are made once a week as follows:

                - Thursday deliveries to: Peninsula Region (beyond Mornington and     
                including Sorrento, Portsea, Main Ridge, Blairgowrie, etc.), Geelong,                     Traralgon, More and Warragul.  You must place your order by 4:00 pm on                 Tuesday for delivery of your order on Thursday of the same week.

                - Tuesday deliveries to: Bendigo and Shepparton. You must place your                     order by 4:00 pm on Friday for delivery of your order on the following                     Tuesday.

3.1.4     If paying for your order by Electronic Funds Transfer or by Check, you will     be notified by email of the delivery date, which will be on the second                     business day after receipt of funds in our bank account.

3.1.5     No orders are processed on weekends and public holidays.

3.1.6     No deliveries are made on weekends and public holidays.

3.1.7     Standard Delivery period is between 7am and 12pm.  We work closely with the carrier to ensure orders are delivered on time, however we cannot be held             responsible for delays encountered by the carrier.

3.1.8    You may request delivery be at any address, however, it is your responsibility to ensure that someone is available at the delivery address at all times during the Standard Delivery period (7 to 12 pm).  Someone must be available to sign for goods on delivery.  Delivery of the goods will only be attempted once.  You are reminded of the perishable nature of the goods and that should You fail to be or have someone else present for your delivery, We reserve the right to charge You in full for an amount equal to the cost of perishable items contained in your order and the cost of delivery.

3.1.9     You acknowledge and agree that by signing for goods on delivery You have checked that the goods delivered to You were completely frozen and in good condition at the time of delivery.  If the goods are not completely frozen or are damaged, reject the delivery and contact us as soon as possible for an exchange or refund.

3.1.10     You acknowledge and agree that the goods are perishable in nature and are required to remain frozen.  You agree to place the goods in a freezer at or below –18 degrees Celsius on delivery.

3.1.11    We reserve the right to restrict deliveries to certain areas, and this includes the right to eliminate certain suburbs from our delivery area altogether.

3.1.12    Please note adverse weather conditions or other events outside of Our reasonable control may result in the occasional late or cancelled delivery of your order.  We will at all times endeavour to contact You as soon as possible, in order to reschedule your delivery date.  In any event, our liability to You will be limited to the price of goods not delivered and the cost of delivery.

    3.2 Fridge-To-Go Lunch Bags

        3.2.1    Items will be shipped to the address You have provided (anywhere in                 Australia) within 2 to 5 business days after receipt of your order and payment.

        3.2.2    Melbourne Metro customers who order fridge-to-go Lunch bags along with         Yamee Organic Baby Food, your delivery will be made in accordance with clause 3.1

4. GST

Where applicable, GST will be included in the price of goods.

5. Cancellation of Order and Refund

5.1     You have the right to cancel any order, which You have placed with Us, provided that you contact us by 8 pm on the same day that You have placed your order.  This can be done by email or phone and will be acknowledged by one of our staff members.  We will refund the payment You have made within 48 hours.  We reserve the right to make a charge of 5% to cover the costs incurred by handling your payment/credit. No refund will be issued for cancellations of food items not received by the cut off time (8 pm on the day that you have placed your order).

5.2       If You have placed your order online and intend to pay for it by Check or Electronic Funds Transfer (EFT), you may cancel your order anytime by email or phone, provided you do so before you send us your payment (by check or EFT).  Cancellation of your order will be acknowledged by one of our staff members.

5.3      Yamee Organic Baby Food

                  •  Please note that it is your responsibility to check the condition of goods on delivery before signing for them.  Should you reject the order due to thawing of goods during dispatch or other damage, please contact us within 24 hours for an exchange or refund.

  • Claims will not be accepted for damaged goods that have been signed for on delivery unless reported within 24 hours of receipt of goods.  We will refund the value of the unused product, however, We reserve the right to require the return of any unused product for testing. 

5.4        Fridge-To-Go Lunch Bags: If you are not 100% satisfied with your purchase you may return it to is in its original packaging within 30 days of purchase for an exchange or refund. To request a return, contact us via our Contact Us page. Please include your order number (as appears on your tax invoice), the item(s) you would like to return and reason for return, and we will gladly exchange or refund, exclusive of delivery, upon return of item(s).  Send item(s) to be returned prepaid and registered to: 34 Bronson Circuit, Cranbourne North, Vic 3977, AUSTRALIA.

6. Complaint Procedure

If you have a complaint of any nature, please email Us at admin@yameeorganicbaby.com.au entitling your email with ‘Complaint’.  Please give Us as much information as You can about your complaint.  We will endeavour to acknowledge your complaint by the next working day and to resolve it within 3 to 5 business days.

8. Personal Details and Privacy Policy

Yamee Organic Baby Food is committed to protecting your privacy.  We do not and will not pass on any details about You to any person not directly employed by US, unless required to do so by the law.  The exception is when we take steps to confirm security of a debit/credit card transaction. 

We will only use the information that we collect about you lawfully for the following purposes:

  • Processing your order.  Delivery information will be disclosed to a delivery or courier service, including telephone details.
  • Improving the Website and the Service you receive.
  • Administering the Website.
  • Notifying you from time to time of special offers and new products

You confirm that this Privacy Policy constitutes your acceptance to Us notifying you about our products from time to time.  You can refuse to receive any marketing emails from us in the future by emailing us at admin@yameeorganicbaby.com.au and entitling the email ‘Unsubscribe’.

We may from time to time on our Website provide links to other websites or resources for you to access at your sole discretion.  You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for

  • The privacy practices of such websites
  • The content of such websites, including (without limitation) any advertising content, products, goods or other materials or services on or available from such websites or resources or
  • The use to which others make of these websites or resources, nor for any damage loss or offence caused or alleged to be caused by, or in connection with, the use of reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

9.  Our Right

We reserve the right to

9.1       Change, modify, substitute or remove any item on the Website without prior warning.

9.2       Changes prices, goods and availability of products at anytime.

9.3       Update product description and accompanying photographs at any time without prior notice.

9.4      refuse service to any customer, and

9.5       amend these Terms and Conditions without notice.

9.6      temporarily suspend access to this Website without notice in the case of system failure, maintenance, new facilities or services or for reasons beyond our control.  We shall not be liable for costs that You may incur as a result.

9.7       permanently suspend access to this Website without notice.  We shall not be liable for costs that You may incur as a result.

10. General

10.1      These Terms and Conditions constitute to the fullest extent permitted by law the whole of the agreement between You and Yamee Organic Baby Food with regard to the use of this Website and the Service.

10.2     These Terms and Conditions are governed by the laws of Australia.  Under Australian law, we may not accept orders from anyone who is under 18 years of age.
